1. Acceptance of Terms

By accessing or using the website located at www.sunnyvalemasonry.com (the "Site"), or by engaging SV Sunnyvale Masonry ("we," "us," or "our") for any services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use this Site or our services. These Terms and Conditions apply to all visitors, customers, and others who access or use the Site.

2. Description of Services

SV Sunnyvale Masonry is a licensed masonry contractor based in Sunnyvale, CA. We provide residential and commercial masonry services including, but not limited to, foundation repair, chimney repair, tuckpointing, brick repair, driveway pavers, retaining wall construction, masonry restoration, fireplace installation, stone veneer installation, concrete block walls, and related trade work.

Use of the Site does not create a contractor-client relationship. A service agreement is only formed when both parties have agreed in writing to a specific scope of work, timeline, and price.

3. Estimates and Pricing

All estimates provided by SV Sunnyvale Masonry are based on the information available at the time of assessment. An estimate is not a final price. The actual cost of work may change if site conditions differ from what was visible during the initial assessment, if the scope of work changes at the customer's request, or if unforeseen conditions are discovered once work begins.

We will notify you in writing before proceeding with any work that exceeds the original estimate. No additional work will be started without your approval. Verbal estimates are not binding - only written, signed estimates form the basis of a service agreement.

4. Scheduling and Cancellation

Once a start date is agreed upon, we ask that you notify us at least 48 hours in advance if you need to cancel or reschedule. Late cancellations that result in wasted crew time, material delivery fees, or permit application costs may be subject to a reasonable cancellation fee, which will be communicated to you in advance.

We reserve the right to reschedule work due to weather conditions, material delays, or other circumstances beyond our control. We will notify you as soon as practicable and work with you to find a new date.

5. Payment Terms

Payment terms will be stated in the written service agreement for each project. For most projects, a deposit is due at or before the start of work, with the balance due upon completion. Accepted payment methods will be specified in the agreement.

Invoices that remain unpaid beyond the agreed payment deadline may be subject to a late fee as specified in the service agreement. We reserve the right to suspend work on a project until outstanding balances are resolved. Disputes about charges must be raised within 10 calendar days of the invoice date.

6. Permits and Inspections

Where required by local ordinance, SV Sunnyvale Masonry will obtain building permits before commencing structural work. Permit fees are typically included in the project estimate. The customer is responsible for ensuring that property access, easements, and any HOA restrictions do not prohibit the work to be performed. We are not liable for project delays caused by permit processing backlogs with local jurisdictions.

7. Warranty

We stand behind our work. Specific warranty terms - including duration and coverage - will be stated in the written service agreement for each project. Warranty coverage applies to defects in workmanship and materials under normal conditions of use. Warranty claims must be submitted in writing within the warranty period.

The warranty does not cover damage caused by acts of nature (including earthquakes or flooding), modifications made to the work by anyone other than SV Sunnyvale Masonry, normal wear and tear, improper maintenance, or conditions that existed prior to our work and were not addressed as part of the agreed scope.

8. Limitation of Liability

To the fullest extent permitted by applicable law, SV Sunnyvale Masonry shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services or this Site, including but not limited to loss of revenue, loss of use, or loss of data, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from a specific project shall not exceed the total amount paid by the customer for that specific project.

9. Warranty Disclaimers

The Site and its content are provided "as is" without warranties of any kind, express or implied. We do not warrant that the Site will be error-free, uninterrupted, or free of viruses or other harmful components. The information on the Site is for general informational purposes and should not be relied upon as professional advice for your specific situation.

10. Dispute Resolution

If a dispute arises between you and SV Sunnyvale Masonry related to our services or these Terms, we encourage you to contact us first at hi@sunnyvalemasonry.com so we can try to resolve it informally. If informal resolution fails, the parties agree to attempt good-faith mediation before pursuing any other legal remedy.

If mediation does not resolve the dispute, any legal action must be filed in the appropriate courts located in Santa Clara County, CA. Both parties consent to personal jurisdiction in those courts.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Santa Clara County, California.

12. Intellectual Property

All content on this Site - including text, images, graphics, logos, and layout - is the property of SV Sunnyvale Masonry or its content suppliers and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any content on this Site without our express written permission.

13. Modifications to These Terms

We reserve the right to update or modify these Terms and Conditions at any time. Changes take effect when posted to the Site, with an updated effective date.
